The elder law practice of GANDERSON LAW, P.C. addresses many of the issues currently facing, and soon to face, older Americans. These issues include safeguarding assets, planning and financing long-term care, and Medicaid planning. Many older Americans are, or will be, confronted with the need for assisted living and/or long-term care. With health care costs at an all-time high and most older Americans living on fixed incomes, it is becoming increasingly important to anticipate future health care needs and begin to plan early. Many financing alternatives have emerged in response to the growing cost of health care needs in order to protect a healthy spouse from being forced to expend all of the couple’s shared resources for the care of one spouse, as well as to protect children from having to bear the expense of their parents’ care. Many of these alternatives are only effective if employed well in advance of needed care.

Elder law is a wide ranging field and the practice of elder law can vary as much as the needs of each individual client. The elder law practice of GANDERSON LAW, P.C. focuses on (i) educating its clients about the various types of care available and the relative costs of such care, (ii) analyzing each individual client's current resources, (iii) informing its clients of the various alternatives available to them to cover the costs of future care, and (iv) working with its clients to implement these alternatives. The clients of GANDERSON LAW, P.C. include both older individuals facing these issues directly, as well as younger individuals who face these issues indirectly when caring for their parents.

Elder law encompasses much more than traditional estate planning. It is of the utmost importance for individuals to familiarize themselves with different alternatives to (i) achieve their estate planning and asset protection goals, and (ii) consider the available options to effectuate planning for Medicare, Medicaid, and related matters, should circumstances warrant. With regard to the latter, individuals need to understand their individual rights concerning Medicare and Medicaid. Far too often, individuals delay planning and, as a result, valuable resources are later expended unnecessarily. GANDERSON LAW, P.C. recognizes the importance of remaining current in many disciplines in order to serve clients effectively. Attendance at seminars and educational conferences is necessary to stay abreast of current developments in this rapidly evolving field. Mr. Ganderson earned his law degree from the Columbus School of Law of the Catholic University of America in 1977. He graduated from the University of Miami, cum laude, with a Bachelor of Business Administration degree in 1973, earning membership in Beta Gamma Sigma.

Mr. Ganderson founded GANDERSON LAW, P.C. in 2008 to accommodate the growth of his predecessor firm, the law office of Martin J. Ganderson, which provided both individuals and businesses with legal counseling for more than twenty years. Prior to entering into the private practice of law, Mr. Ganderson practiced as a certified public accountant with the national accounting firm Ernst & Ernst.

Mr. Ganderson is a member of the Virginia State Bar, the American Bar Association, the Norfolk and Portsmouth Bar Association, the National Academy of Elder Law Attorneys, the American Association of Attorney-Certified Public Accountants, and the Hampton Roads Tax Forum. Mr. Ganderson is admitted to practice in the Supreme Court of Virginia, the United States Court of Appeals for the Fourth Circuit, the United States District Court for the Eastern District of Virginia, and the United States Tax Court.

Mr. Ganderson is a co-author of (i) "Fundamental Issues in Elder Law," National Business Institute, Inc. (2006); (ii) "Business Entities," Peoples’ Law School, sponsored by the Virginia Trial Lawyers Association (1994); (iii) "How to Draft Wills and Trusts in Virginia," National Business Institute, Inc. (1994); (iv) "Virginia New Tax Law Update: How the Budget Reconciliation Act of 1993 Affects You and Your Business," National Business Institute, Inc. (1994); and (v) "Basic Drafting of Wills and Trusts in Virginia," National Business Institute, Inc. (1991).

Mr. Ganderson is a native of Norfolk, Virginia, and graduated from Granby High School. He is married to the former Robin Patricia Kruger, and has two children, Justin (who earned his law degree from the University of Miami, and his undergraduate degree from Cornell University, and is now an associate attorney at the law firm of McKenna Long & Aldridge LLP [Washington, D.C. office]) and Matthew (who earned his undergraduate degree from Wake Forest University [having transferred from Colby College] and is now pursuing a graduate degree in school counseling at Old Dominion University).

Mr. Ganderson is an avid sports fan, and took special pride in his son, Justin, being a member of the football team at Maury High School (All-Tidewater Punter, 1997) and Cornell University, and his son, Matthew, being a member of the basketball teams at Maury High School and Norfolk Academy (All TCIS and Virginia Prep League, 2001) and at Colby College. Mr. Ganderson is a member of the 2008-2009 Downtown Norfolk Council Board of Directors. Outside of his interests in his family and the law, Mr. Ganderson’s favorite pastimes are physical training and being an avid supporter of the University of Miami Hurricane football team.
