Estate Planning & Administration
Attorneys in LeClairRyan's Estate Planning & Administration practice assist clients in the planning and implementation of estate plans designed to fulfill their personal and family objectives while, at the same time, minimizing transfer taxes. Working closely with the client's accountant, insurance and financial advisors, our attorneys review financial and personal information provided by the client and recommend appropriate estate planning measures and documents. We have extensive experience in drafting wills, trusts, powers of attorney, living wills and medical powers of attorney. The Firm routinely prepares documents for wealthy clients who have significant tax planning goals, including wills and trusts designed to fully utilize the client's estate tax exemption equivalent and generation-skipping transfer tax exemption. In addition, our attorneys assist clients with more sophisticated and specialized tax planning vehicles designed to utilize, during the client's lifetime for additional tax savings, the client's annual gift tax exclusions, estate and generation-skipping transfer tax exemptions and charitable deductions. These vehicles include irrevocable life insurance trusts (ILITs), family partnerships and LLCs, qualified personal residence trusts (QPRTs), grantor retained income trusts (GRITs and GRATs), "dynasty" trusts, generation-skipping trusts (GSTs), qualified terminable interest property trusts (QTIPs), charitable remainder and lead trusts (CRTs and CLTs), and trusts for children or other family members with special needs.
In addition, the Firm represents executors and heirs in the proper administration of decedents' estates following death, as well as in tax planning, governmental filings and compliance with the IRS, state and local tax authorities, and the local clerks and commissioners of accounts. We also advise and represent clients with respect to gift and estate tax return audits, appeals and litigation.
